2. Scope of Services

gunarservice provides IT consultancy, software development, and digital services to business (B2B) and consumer (B2C) clients. No physical goods or products are sold or shipped. All deliverables are provided digitally or as professional services.

3. Pricing and Payment Terms

All prices are quoted in Euros (€). Due to the legal status of the provider (Entreprise Individuelle under the micro-enterprise regime), VAT is not charged (TVA non applicable, art. 293 B du CGI).
Payments are processed securely through authorized third-party online payment gateways integrated into the website.
Services are provisioned or scheduled only upon receipt of full payment or as otherwise agreed in writing via a formal service contract or invoice.

4. Right of Withdrawal and Digital Services Waiver (B2C)

Legal Withdrawal Period: In accordance with French and European consumer law, consumers (B2C clients) generally have a 14-day right of withdrawal from the date of contract conclusion, without needing to provide a reason.
Express Waiver for Digital/Immediate Services: By purchasing and requesting the immediate execution, delivery, or commencement of digital services, consulting, or software development before the expiry of the 14-day withdrawal period, the client expressly requests immediate performance and acknowledges and agrees that they lose their right of withdrawal once the service has begun or digital content has been delivered.

5. Intellectual Property

All intellectual property rights, source code, documentation, and materials created or provided by gunarservice remain the exclusive property of Markunaitis Gunars until full and final payment is received. Upon full payment, the client receives a license to use the deliverables strictly as specified in the project scope or invoice.

6. Limitation of Liability

gunarservice provides IT consultancy and digital services with a duty of professional care (obligation de moyens). To the maximum extent permitted by applicable French law, gunarservice shall not be liable for any indirect, incidental, or consequential damages, loss of data, or business interruption arising from the use or inability to use the services provided.
Nothing in these terms limits liability for death, personal injury caused by negligence, or fraud.

7. Governing Law and Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with French law. In the event of a dispute, professional clients and consumers agree to seek an amicable solution prior to initiating legal action. Consumers retain the right to engage a certified consumer mediator under French law before turning to the competent courts of Roubaix / Lille, France.
