Clear guidelines on cancellations and refunds for digital services

1. Nature of Services
gunarservice operates exclusively as an IT consultancy, software development, and digital service provider (Entreprise Individuelle under NAF code 62.01Z). Because all deliverables are provided digitally or as professional services, no physical goods are sold, shipped, or returned. Consequently, traditional physical return policies, shipping fees, or return merchandise authorizations (RMAs) do not apply.
2. Consumer Right of Withdrawal (B2C)
In accordance with French and European consumer protection laws (Article L. 221-18 of the French Consumer Code), individual consumers (B2C clients) generally have a 14-day right of withdrawal from the date of contract conclusion, without needing to provide a justification or incur penalties.
3. Waiver of Withdrawal for Digital and Immediate Services
Express Request for Immediate Execution: By purchasing digital services, software development, or consulting hours that are scheduled to commence or be delivered immediately before the expiration of the 14-day withdrawal period, the client expressly requests the immediate performance of the service.
Loss of Withdrawal Right: In compliance with Article L. 221-28 of the French Consumer Code, the client acknowledges and explicitly agrees that they lose their right of withdrawal once the digital service has been fully performed, or once digital delivery/consulting execution has begun with their prior express consent.
4. Project Cancellations and Refunds
Pre-Commencement Cancellation: If a client cancels a scheduled project or consultancy engagement in writing before any work has commenced or deliverables have been sent, a full refund may be issued, minus any non-refundable administrative or transaction processing fees incurred.
Post-Commencement / Milestone-Based Work: Once work, development, or consulting has begun, cancellations must be submitted in writing to contact@gunarservice.site. The client will be billed for all work completed up to the date of cancellation based on the agreed milestone or hourly rate, and partial refunds for unperformed phases will be evaluated on a case-by-case basis.
Refund Processing: Approved refunds will be processed using the original method of payment within 5 to 10 business days.
